Bankruptcy Reform Legislation

Calling America a nation of personal responsibility where people are expected to meet their obligations, President George W. Bush signed the Bankruptcy Abuse Prevention, Consumer Protection Act significant bankruptcy reform legislation on April 20, 2005. This controversial legislation makes it harder for people with debt to wipe clean their financial slates by declaring bankruptcy.

In other words, filing for bankruptcy may no longer be a means to keep your home.

Foreclosure Prevention

When a homeowner faces foreclosure, there are various options available. We will briefly examine some of the most popular ones:

Reinstating the loan is the most efficient way to stop foreclosure proceedings and to bring your delinquent payments up to date, making the loan current. However, there are costs the consumer will have to pay over and beyond the late payments, such as additional late charges and attorney fees.

Selling your home against the foreclosure clock is tricky. Lenders don’t take kindly to delays. If the house is not sold in time for foreclosure, there’s no turning back. The best way to go about selling the home in this situation is to contact a real estate agent that is familiar with foreclosure investing. They may be able to put you in contact with investors that will be happy to buy your home.

Submitting a deed in lieu of foreclosure is the procedure in which the homeowner voluntarily gives the house back to the lender. The lender, however, is not obligated to accept it. You should discuss with the lender how they will report it back to the proper agencies. Should the lender refuse the deed, they are required to file a Notice of Non Acceptance with the county recorder.

Doing nothing is the paralyzing result some resort to when they are feeling overwhelmed. Do not ignore the lender and do nothing. Don't fall into this trap. You have options when in foreclosure; Open up a dialogue with them to find out what the course of action is. Always be proactive. Remember nothing yields nothing.
